About

Nathan is a member of Skoubye Nielson Johansen & Baxter, where he focuses on construction law, appellate advocacy, and commercial litigation. He represents owners, developers, general contractors, subcontractors, material suppliers, and sureties in disputes at every stage, from negotiation and mediation through arbitration, trial, and appeal. His construction practice includes construction lien foreclosure litigation, Utah Residence Lien Recovery Fund claims, payment bond claims under Utah law and the federal Miller Act, construction defect litigation, and contract disputes. He also negotiates and drafts construction and real estate agreements and condominium and HOA governing documents.

Nathan's appellate background shapes how he handles construction cases. He has represented contractors in published Utah Court of Appeals decisions interpreting Utah's construction lien statutes. For example, in Vineyard Properties of Utah LLC v. RLS Construction LLC, 2021 UT App 144, the court affirmed a judgment for his client, holding that a contractor's lien for tenant improvements attaches to the landlord's fee interest under the current lien statutes. The court also awarded his client its attorney fees on appeal. In Busico v. Carver, 2023 UT App 162, he obtained a reversal of the trial court's ruling that his contractor client was not entitled to lien rights under the statute's preliminary-notice savings provision and recovered his client's attorney fees.

Before his current practice, Nathan was an Assistant Solicitor General in the Utah Attorney General's Office. There he briefed nearly 20 appeals and presented five oral arguments before the Utah Court of Appeals. He also handled three appeals in the Nebraska state appellate courts and two in the Eighth Circuit.

Nathan is a member of the Construction Law and Appellate Advocacy sections of the Utah State Bar. He has presented on construction liens to the Bar's Real Property Section. He was selected as a Super Lawyers Rising Star in 2022.
